LoveStreaks Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Daitoku Corp. ("LoveStreaks," "we," "us," or "our"). They govern your account and access to and use of the LoveStreaks iOS application, website, backend, content, support, and related services (collectively, the "Service"). The license to the iOS application is also governed by Apple's Standard EULA.

Please read these Terms and the LoveStreaks Privacy Policy. By creating an account, tapping an acceptance control, purchasing Premium, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Nothing in these Terms excludes or limits a right or remedy that applicable consumer law does not permit us to exclude or limit.

1. Eligibility

You must be at least 13 years old and at least the minimum age required to consent to an online service where you live. If you have not reached the age of legal majority, your parent or legal guardian must review and agree to these Terms for you.

Optional intimacy prompts are for adults aged 18 or older. They are hidden by default. You must not enable or use them unless you are at least 18.

You may not use the Service if doing so is prohibited by law, if you are subject to applicable sanctions or restricted-party rules, or if we previously terminated your account for serious or repeated violations and have not authorized your return.

2. Accounts and Sign in with Apple

You must use Sign in with Apple and provide accurate, lawful account information. You are responsible for:

• protecting your Apple Account, device passcode, and access to your device;
• activity performed through your account, except to the extent caused by our breach of duty;
• promptly notifying support@lovestreaks.app of suspected unauthorized access; and
• keeping your display name and other information current.

You may not sell, transfer, share, automate, or create an account for another person. Friend codes are for inviting people you know; they are not credentials, but you should still share them carefully.

3. What LoveStreaks provides

LoveStreaks lets users create private solo, romantic, friendship, family, or group relationships; invite selected users; choose or create streaks; record activity; view relationship statistics; schedule local reminders; and use eligible free or Premium features.

The Service is a motivational and organizational tool. It does not guarantee that a streak, relationship, reminder, notification, statistic, or synchronized state will always be uninterrupted, error-free, or preserved forever. Internet, device, Apple, and hosting failures can delay or prevent delivery.

We may add, improve, limit, replace, or discontinue features. If a change materially affects a paid subscription, we will follow applicable law and Apple's requirements.

4. Relationships, invitations, and shared control

Only invite people you trust and have permission to contact. When you join a relationship:

• the other members can see the shared names, membership, streak content, activity, and statistics described in the Privacy Policy;
• member actions can change shared state for everyone;
• a group administrator may manage group settings, invitations, members, and administrative transfer;
• leaving or deleting a relationship can affect shared data; and
• another member may retain lawful copies or screenshots outside our control.

Blocking a person cancels pending invitations between the two accounts and prevents new invitations in either direction. If you and that person currently share the relationship from which you block them, blocking also immediately removes you from that relationship. In a one-to-one relationship, the other member keeps a solo copy and its existing non-deleted history. In a group, the group remains for the other members and administration transfers when necessary. Other members are told only that somebody left, not that a block caused the departure. In a safety emergency, also contact local emergency services or law enforcement as appropriate.

5. User content

"User Content" includes display names, group names, custom streak text, report details, support messages, and other material you submit.

5.1 Your ownership and limited license

As between you and LoveStreaks, you retain any rights you hold in your User Content. You grant LoveStreaks a non-exclusive, worldwide, royalty-free, sublicensable-to-our-service-providers license to host, store, reproduce, transmit, display, format, filter, and otherwise process User Content only as reasonably necessary to:

• operate and secure the Service;
• display it to the relationship members you selected;
• process a safety report and enforce these Terms;
• provide support; and
• comply with law and protect legal rights.

This license ends when the content is deleted from active systems, except for limited backup, safety, legal-hold, and compliance copies described in the Privacy Policy.

5.2 Your promises

You represent and warrant that:

• you own or have all permissions needed for your User Content and our permitted processing of it;
• your content and conduct do not violate law, another person's rights, these Terms, or the safety rules below; and
• you will not enter another person's confidential, health, financial, government-identifier, or similarly sensitive information without their informed permission and a lawful reason.

Do not use custom streaks to keep passwords, authentication codes, payment-card data, government identifiers, medical records, precise location, or information whose disclosure could create a serious safety risk.

5.3 Account deletion and shared state

Deleting your account removes custom streak definitions you authored and active or inactive tracked copies of those definitions. A shared relationship may remain for its other members, but your membership and identity fields are removed. Remaining members may keep shared relationship history that is not your authored free-form content. Narrow pseudonymous deletion receipts and Apple transaction records may be retained as stated in the Privacy Policy.

6. Safety rules and prohibited conduct

You must not use or attempt to use the Service to:

1. harass, stalk, bully, threaten, coerce, exploit, shame, or intimidate anyone;
2. submit hate speech, unlawful discrimination, graphic violence, pornography, sexual exploitation, or content that sexualizes a minor;
3. promote suicide, self-harm, dangerous challenges, abuse, trafficking, terrorism, or other serious harm;
4. impersonate another person, LoveStreaks staff, support, or an administrator;
5. infringe privacy, publicity, confidentiality, copyright, trademark, or other rights;
6. disclose another person's private or sensitive information without lawful permission;
7. solicit passwords, payment credentials, government identifiers, sexual material from a minor, or illegal goods or services;
8. spam invitations, scrape users or friend codes, harvest data, or use the Service for unsolicited promotion;
9. evade a block, suspension, content filter, rate limit, security control, or moderation decision;
10. probe, scan, reverse engineer, disrupt, overload, introduce malware to, or gain unauthorized access to the Service, except to the limited extent a restriction is prohibited by law;
11. use bots or automated access without our written permission;
12. falsify subscription, transaction, device-integrity, identity, or streak data; or
13. use the Service for unlawful, fraudulent, or rights-violating activity.

The intimacy category is for consensual adult relationship prompts. It may not be used to facilitate exploitation, prostitution, trafficking, non-consensual conduct, or explicit pornographic content.

7. Reports, blocks, and moderation

You may report eligible relationship or custom-streak content and may optionally block the related account. Reports must be honest, made in good faith, and not used to retaliate or harass.

We may use automated filtering and human review. We may dismiss a report, remove specific custom content, reset a violating display name, require onboarding again, restrict features, suspend or terminate an account, preserve evidence, or contact competent authorities when legally required or reasonably necessary to address imminent serious harm. We may act without advance notice where notice would create risk, enable evasion, or conflict with law.

We aim to respond to credible safety concerns promptly, but no review time is guaranteed. LoveStreaks is not an emergency service. If someone may be in immediate danger, contact the appropriate local emergency service.

To appeal a moderation decision, email support@lovestreaks.app with enough information to identify the decision. We may reject repetitive, abusive, or fraudulent appeals.

8. Premium subscriptions

LoveStreaks may offer monthly and yearly auto-renewable Premium subscriptions through Apple's In-App Purchase system. The purchase screen shows the current localized price, billing period, and included features before purchase. Prices, taxes, trials, and offers may vary by country and Apple Account.

By purchasing:

• payment is charged to your Apple Account when Apple confirms the purchase;
• the subscription automatically renews for the same period unless canceled at least 24 hours before the current period ends;
• Apple may charge the renewal within 24 hours before the current period ends at the price Apple discloses;
• you can manage or cancel through Apple Account subscription settings;
• cancellation stops future renewal but normally does not provide a prorated refund for the current period;
• refund eligibility and processing are controlled by Apple and applicable law; and
• deleting your LoveStreaks account or app does not cancel Apple billing.

Use "Restore Purchases" to restore an eligible subscription. Premium entitlement depends on a verified Apple transaction and may be delayed while Apple or our backend is unavailable. A relationship may receive Premium features through an eligible member; other members are not charged through that person's purchase.

Under the currently disclosed limits, a free account may create one active relationship and a Premium subscriber may create up to 50. Relationships you join by accepting invitations do not consume your own creation allowance. Standalone outgoing invitations reserve a creation slot while pending.

When Premium expires, is canceled, refunded, or revoked, the app applies the then-disclosed free-tier limits. Existing tracked streaks may remain usable as described in the product, but Premium-only creation, library, capacity, lives, or customization benefits can become unavailable. We do not guarantee that a particular Premium feature will remain unchanged forever.

Apple, not LoveStreaks, controls payment methods, billing authorization, taxes collected by Apple, family-sharing eligibility, storefront rules, and Apple refund decisions.

9. Local reminders and communications

Local reminders are optional and require iOS notification permission. You may disable reminders in LoveStreaks or notifications in iOS Settings. Reminders are convenience tools only; device settings, timezones, focus modes, operating-system behaviour, and app state can delay or suppress them.

We may show operational notices in the app for maintenance, security, legal updates, or material Service changes. We do not use notification permission as a condition for unrelated core functionality.

10. Not medical, mental-health, or relationship advice

LoveStreaks does not provide medical, mental-health, legal, financial, therapeutic, sexual-health, or professional relationship advice. Generic wellness and intimacy prompts are informational suggestions, not diagnoses, treatment, consent, or a substitute for qualified professional help.

A completion, "life," streak death, score, or statistic is a product metaphor and must not be used to pressure, punish, monitor, or coerce another person. Consent must be freely given for every real-world activity and can be withdrawn at any time, regardless of any streak.

You are responsible for deciding whether an activity is safe and appropriate for you. Stop and seek qualified help where appropriate.

11. LoveStreaks intellectual property and app license

The Service, including software, design, branding, built-in prompts, graphics, and documentation, is owned by or licensed to LoveStreaks and protected by applicable law. Apple's Standard EULA grants and governs the app license. These Terms provide additional rules for your LoveStreaks account, User Content, relationships, subscriptions, and backend services. If a license term in these Terms conflicts with a mandatory term of Apple's Standard EULA, the Standard EULA controls the app license.

The app is licensed, not sold. No right is granted except as expressly stated. You may not copy, distribute, sublicense, sell, rent, publicly exploit, modify, or derive source code from the Service except as law expressly permits despite this restriction or as an applicable open-source license permits.

Feedback is voluntary. You grant us a perpetual, irrevocable, worldwide, royalty-free right to use non-confidential feedback without identifying or compensating you. Do not submit feedback you are not permitted to provide.

12. Third-party services and terms

The Service depends on Apple and cloud service providers. You must comply with applicable third-party terms, including the Apple Media Services Terms and your wireless or internet service agreement. Third-party services may be unavailable, changed, or governed by separate privacy and contractual terms.

Links to external sites are provided for convenience. We do not control and are not responsible for their content or practices.

13. Suspension and termination

You may stop using the Service, leave eligible relationships, cancel Premium through Apple, or delete your account at any time.

We may restrict, suspend, or terminate access, remove content, or decline an invitation or transaction when reasonably necessary to:

• enforce these Terms or law;
• address fraud, abuse, safety, security, or intellectual-property risk;
• protect users, third parties, Apple, providers, or the Service;
• respond to a valid legal request; or
• discontinue the Service.

Where appropriate and lawful, we will provide notice and a chance to cure or appeal. Serious violations may result in immediate action. Termination ends the license in Section 11. Provisions that by their nature should survive—including ownership, payment obligations already incurred, disclaimers, liability, disputes, and enforcement rights—survive.

14. Service availability, disclaimers, and warranties

We use reasonable care and skill required by applicable law. Except for rights and warranties that cannot lawfully be excluded, the Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim implied warranties and conditions of merchantability, satisfactory quality, fitness for a particular purpose, quiet enjoyment, accuracy, non-infringement, uninterrupted availability, and data preservation.

We do not warrant that:

• every reminder, synchronization, report, or invitation will arrive on time;
• streak counts or statistics will be suitable for a particular personal use;
• user content will be accurate, lawful, or safe;
• the Service will be free of defects, attacks, or loss; or
• relationships or real-world outcomes will improve through use.

Some jurisdictions do not allow particular exclusions, so they apply only to the extent lawful.

15. Limitation of liability

To the maximum extent permitted by law, LoveStreaks and its directors, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, goodwill, opportunity, or data; personal disputes between users; or damages arising from unauthorized use outside our reasonable control.

To the maximum extent permitted by law, our aggregate liability for all claims arising from the Service during any 12-month period will not exceed the greater of:

1. the amount you paid for LoveStreaks during the 12 months before the event giving rise to the claim; or
2. CAD $100.

These limitations do not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence where liability cannot be excluded, violation of non-waivable privacy or consumer rights, or any liability that applicable law does not permit us to limit. The limitations apply even if a remedy fails of its essential purpose.

16. Responsibility for unlawful conduct

To the extent permitted by law, you are responsible for losses and reasonable costs directly resulting from your unlawful User Content, fraud, wilful misconduct, or material breach of Sections 5 or 6. This does not require a consumer to indemnify us for our own negligence, breach, or conduct for which applicable law makes us responsible.

17. Governing law and disputes

Before filing a claim, you and LoveStreaks agree to make a good-faith effort to resolve it informally for 30 days after written notice. Send notices to support@lovestreaks.app. This does not stop either party from seeking urgent injunctive relief, reporting to a regulator, using an available small-claims process, or meeting a legal filing deadline.

Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules, and the courts located in Ontario, Canada have non-exclusive jurisdiction.

If you are a consumer, you retain any mandatory protections and forum rights of your place of residence. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Apple App Store and Standard EULA

For an app obtained through Apple's App Store, Apple's Standard EULA governs the app license. You and LoveStreaks also acknowledge and agree that:

1. these Terms are between you and LoveStreaks, not Apple, and LoveStreaks—not Apple—is responsible for the app and its content;
2. Apple has no obligation to provide maintenance or support for the app;
3. if the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the app's purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation, and LoveStreaks is responsible for other claims attributable to a warranty failure;
4. LoveStreaks, not Apple, is responsible for addressing claims relating to the app or your possession or use of it, including product-liability, legal or regulatory compliance, and consumer-protection or privacy claims;
5. LoveStreaks, not Apple, is responsible for investigating, defending, settling, and discharging a third-party intellectual-property claim relating to the app;
6. you represent that you are not located in a country subject to a U.S. Government embargo or designated as supporting terrorism and are not listed on a U.S. Government prohibited- or restricted-party list;
7. you must comply with applicable third-party terms when using the app; and
8. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce these Apple-related provisions against you.

19. Changes to these Terms

We may update these Terms for legal, security, operational, or product reasons. We will post the revised Terms, update the date above, and give additional notice when required. Material changes apply prospectively after the stated effective date. If law requires consent, we will request it. If you do not agree to a material change, stop using the Service and cancel any future Apple renewal before the change takes effect.

20. General terms

• Entire agreement. These Terms, the Privacy Policy, purchase disclosures, and any feature-specific terms are the entire agreement about the Service, subject to the Apple Standard EULA where it independently applies.
• Order. A mandatory law controls over conflicting terms. A purchase-screen disclosure controls for the price and period shown in that transaction.
• Severability. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions continue.
• No waiver. Failure to enforce a provision is not a waiver.
• Assignment. You may not assign these Terms without our consent. We may assign them in connection with a bona fide reorganization or transfer of the Service, subject to applicable law and the Privacy Policy.
• No agency. These Terms do not create employment, partnership, joint venture, fiduciary, or agency duties between you and LoveStreaks.
• Headings. Headings are for convenience and do not change meaning.
• Electronic communications. You consent to receive legally permitted electronic notices through the app, website, or contact information you provide.
